OVERVIEW
Welcome to Lethu Hair & Beauté. The terms “we,” “us,” and “our” refer to Lethu Hair & Beauté. We operate this website and online store to provide customers with access to our hair, beauty and related products, information, content, features, tools and services (collectively, the “Services”). Our online store is hosted and powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies made available through our website, govern your access to and use of our Services and your purchases from Lethu Hair & Beauté, whether your order is shipped, delivered, or collected through local pickup.

By visiting our website, browsing our products, placing an order, arranging local pickup, purchasing from us, or otherwise using our Services, you agree to be bound by these Terms. Please read them carefully before using our website or completing a purchase.

Lethu Hair & Beauté operates in Ontario, Canada. These Terms are intended to operate in accordance with applicable Canadian and Ontario laws, including applicable consumer protection and privacy legislation. Nothing in these Terms is intended to exclude, restrict or waive any right or remedy that cannot legally be excluded, restricted or waived under applicable law.

Product availability, prices, descriptions and promotions may change from time to time. Additional conditions may apply to certain products, promotions, shipping, delivery or local pickup options and, where applicable, those conditions will be disclosed to you.

If you do not agree with these Terms or our applicable policies, you should not use our Services or complete a purchase. If there is a conflict between these Terms and a right provided to you under applicable law that cannot legally be waived, the applicable law will prevail.

SECTION 1 – ACCESS AND ACCOUNT
By using our Services, you represent that you are at least the age of majority in your province or territory of residence, or that you are using the Services with the involvement and permission of a parent or legal guardian where required by law. In Ontario, the age of majority is 18 years.

When placing an order or creating an account with Lethu Hair & Beauté, you agree to provide current, accurate and complete information, including your name, email address, telephone number, billing information and, where applicable, shipping or local pickup information. You are responsible for promptly updating this information when necessary.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You must notify us promptly if you believe your account has been accessed or used without authorization.

You may not use our website, account features or Services for any unlawful or fraudulent purpose, nor may you use the Services in a manner that violates applicable federal, provincial or local laws or regulations.

When completing an online purchase, you are responsible for reviewing your order information, including the products selected, quantities, prices, shipping or pickup method and contact information, before submitting your order. Where required by applicable consumer protection law, you will be provided an opportunity to review and correct errors before completing the transaction.

We reserve the right to refuse service, restrict or terminate accounts, or cancel orders where we reasonably believe there has been fraud, misuse of our Services, unauthorized activity, violation of these Terms, or other unlawful conduct, subject to applicable law. Nothing in this section limits any rights or remedies available to consumers under applicable law.

SECTION 2 – OUR PRODUCTS
We make reasonable efforts to ensure that the descriptions, photographs, colours, textures, lengths, sizes, ingredients, specifications and other information relating to products offered by Lethu Hair & Beauté are accurate and current. However, the appearance of products may vary slightly from photographs displayed on our website due to lighting, photography, screen settings, manufacturing variations and, where applicable, the natural characteristics of human hair and other hair products.

For wigs, extensions, braiding hair and other hair products, slight variations in colour, texture, curl pattern, density, length or appearance may occur. Where a product is made from natural or human hair, individual strands and finished products may not be completely identical. Such reasonable variations do not necessarily indicate that a product is defective.

Customers are responsible for reviewing product descriptions, colours, lengths, sizes, quantities and other applicable product details before completing a purchase. Product availability is not guaranteed, and we reserve the right to discontinue products, limit quantities or modify our product selection at any time.

Certain beauty, hair-care and cosmetic products may contain ingredients that can cause sensitivities or allergic reactions. Customers should review product labels, ingredients, warnings and manufacturer instructions before use and perform any recommended patch or strand test where applicable. Products must be used only as directed by the manufacturer.

We do not manufacture every product sold through Lethu Hair & Beauté. Products manufactured by third parties remain subject to applicable manufacturer instructions, warnings and warranties, where applicable.

Nothing in this section excludes or limits any statutory warranty, consumer right or remedy available under applicable Canadian or Ontario law. Product descriptions and representations made by Lethu Hair & Beauté will not knowingly be false, misleading or deceptive.

SECTION 3 – ORDERS
When you place an order with Lethu Hair & Beauté, you are making an offer to purchase the products in your order. Submission of an order does not guarantee acceptance. We reserve the right to accept, decline or cancel an order where reasonably necessary, including because of product unavailability, pricing or listing errors, suspected fraud, payment issues or circumstances beyond our reasonable control, subject to applicable law.

Before submitting your order, you are responsible for reviewing the products selected, quantities, colours, shades, textures, lengths and other product options, as well as your contact information, billing information and selected shipping, delivery or local pickup method. Our checkout process provides customers with an opportunity to review their order and correct errors before completing the purchase.

Payment must be successfully authorized before an order is processed. After an online order is completed, an order confirmation will be sent to the email address or other contact information provided at checkout. Customers are responsible for providing accurate and current contact information.

Products are subject to availability. If an item becomes unavailable after an order has been placed, we may contact you to offer an appropriate alternative, provide a refund for the unavailable item, or cancel the affected portion of the order. We will not substitute a product without your agreement where doing so would materially change your purchase.

LOCAL PICKUP: Where local pickup is offered, customers must select the applicable pickup option at checkout or as otherwise arranged with Lethu Hair & Beauté. Customers will be notified when their order is ready for pickup. Please do not arrive for pickup before receiving confirmation that your order is ready. Pickup instructions, including the designated pickup location and any applicable pickup window, will be provided directly to the customer.

Customers may be required to provide their order confirmation and/or identification reasonably necessary to verify the order before it is released. Once an order has been collected by the customer or their authorized representative, it will be considered delivered, subject to the customer's rights under applicable law.

Requests to modify or cancel an order should be made as soon as possible by contacting Lethu Hair & Beauté. We cannot guarantee that an order can be changed or cancelled once processing, preparation, shipping or delivery has begun. Any cancellation, return, exchange or refund remains subject to our applicable policies and any rights available to the customer under Ontario law.

We reserve the right to limit quantities or refuse orders that reasonably appear to be intended for unauthorized resale, fraudulent activity or other misuse of our Services. Nothing in this section limits any non-waivable rights or remedies available to consumers under applicable law.

SECTION 4 – PRICES AND BILLING
Prices for products offered by Lethu Hair & Beauté are displayed in Canadian dollars (CAD) unless otherwise clearly stated.

Product prices may change from time to time without prior notice. The price applicable to your purchase will be the price displayed and confirmed during checkout at the time your order is placed, subject to correction of genuine pricing or listing errors and applicable law.

Applicable taxes, shipping or delivery charges, discounts and other applicable charges will be calculated or disclosed during checkout before you complete your purchase. Where additional charges may apply and can reasonably be determined in advance, they will be disclosed as required by applicable law. Ontario's current rules for applicable internet agreements require disclosure of itemized prices, taxes, shipping charges, additional charges, the total amount payable, and payment terms.

You agree to provide current, complete and accurate billing, payment and contact information for all purchases made through our Services. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

Payment is subject to authorization by your payment provider. We may delay processing, decline or cancel an order if payment cannot be authorized or if we reasonably suspect fraudulent or unauthorized activity, subject to applicable law.

Promotional codes, discounts and special offers are subject to their stated terms and conditions. Unless otherwise stated, promotions cannot be combined. Discounts have no cash value and cannot be applied retroactively to purchases completed before the promotion began.

If we discover an obvious pricing, product or billing error after an order has been submitted, we may contact you before fulfilling the affected item to provide the correct information and, where appropriate, allow you to confirm or cancel the affected purchase. We will not knowingly charge an amount different from the amount you authorized without your agreement or other lawful basis.

Nothing in this section limits any pricing, disclosure, cancellation, refund or other rights available to consumers under applicable law.

SECTION 5 – SHIPPING, DELIVERY AND LOCAL PICKUP
Lethu Hair & Beauté may offer shipping, delivery and local pickup options for eligible orders. Available fulfillment options, applicable charges and estimated delivery or pickup information will be provided at checkout or otherwise communicated to you before fulfillment.

Shipping and Delivery: Orders are generally processed within the timeframe stated in our Shipping Policy. Any delivery dates or timeframes provided are estimates unless expressly stated otherwise. Delivery may be affected by carrier delays, weather, holidays, high order volumes or other circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information. If you discover an error in your shipping address, please contact us as soon as possible. We will make reasonable efforts to correct the information before shipment, but changes cannot be guaranteed once an order has been processed or transferred to a carrier.

Shipping charges and other applicable delivery charges will be disclosed at checkout before you complete your purchase. Tracking information may be provided when available.

Local Pickup: Local pickup may be available for eligible orders in Embrun, Ontario. Customers will be notified when their order is ready and provided with the applicable pickup instructions. Please do not arrive for pickup until you have received confirmation that your order is ready.

Customers may be required to provide their order confirmation and/or identification reasonably necessary to verify the order. If another person will collect your order, you may be required to authorize that person before the order is released.

Please collect local pickup orders within the timeframe stated in our Shipping & Local Pickup Policy or contact us to make alternative arrangements.

Delayed, Lost or Misdelivered Orders: If an order is delayed, lost or appears to have been misdelivered, please contact us. We will reasonably assist with reviewing tracking information and, where appropriate, communicating with the carrier. Any resolution will depend on the circumstances, applicable carrier procedures and your rights under applicable law.

Nothing in these Terms removes or restricts any statutory right you may have regarding delivery. Where applicable Ontario consumer protection legislation gives you a right to cancel because goods have not been delivered within a legally prescribed period, that right will continue to apply regardless of anything stated in these Terms.

SECTION 6 – INTELLECTUAL PROPERTY
The Services, including our website and all content made available through it, may contain intellectual property owned by or licensed to Lethu Hair & Beauté, Shopify, our suppliers, licensors or other third parties. This may include, without limitation, trademarks, trade names, logos, branding, photographs, graphics, product descriptions, written content, designs, videos, audio, website layout and other materials.

Except where otherwise stated, content owned by Lethu Hair & Beauté is protected by applicable Canadian intellectual property laws, including the Copyright Act and Trademarks Act, as well as other applicable laws and international protections. Copyright in original works generally includes the exclusive right to reproduce the work or a substantial part of it.

You may access and use our website and Services for your personal, non-commercial shopping purposes. You may not copy, reproduce, republish, distribute, modify, sell, exploit, display or otherwise use our protected content for commercial purposes without prior written permission from Lethu Hair & Beauté or the applicable rights holder.

Nothing in these Terms grants you ownership of or a licence to use the name Lethu Hair & Beauté, our logos, branding, slogans or other proprietary material except as expressly authorized by us in writing.

Product names, brand names, logos, photographs and other intellectual property belonging to third-party manufacturers, suppliers or brands remain the property of their respective owners. Their appearance on our website does not transfer any ownership rights to Lethu Hair & Beauté or to you.

You must not use intellectual property belonging to another person or business in connection with our Services in a manner that infringes their rights. If you believe content available through our Services infringes your intellectual property rights, please contact us at info@lethuhairandbeaute.ca or 613-314-9050 with sufficient information for us to review your concern.

Nothing in this section is intended to restrict any use that is permitted by applicable intellectual property law.

SECTION 7 – OPTIONAL TOOLS

From time to time, Lethu Hair & Beauté may provide access to features, applications, integrations or tools supplied or operated by third parties. These may include, for example, payment services, shipping or tracking services, product-review features, social media integrations or other functionality made available through our website.

We may not monitor, control or have input over the operation of third-party tools. Unless otherwise expressly stated, access to third-party tools is provided on an “as is” and “as available” basis and does not constitute an endorsement or guarantee by Lethu Hair & Beauté.

Your use of any optional third-party tool may also be governed by the terms, conditions and privacy practices of the applicable third-party provider. You are responsible for reviewing those terms before choosing to use the tool.

To the extent permitted by applicable law, Lethu Hair & Beauté is not responsible for losses or damages caused solely by the operation, availability or use of an independent third-party tool that is outside our reasonable control. Nothing in this section excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited.

We may introduce additional features, tools or services in the future. Unless otherwise stated, those additions will form part of the Services and will be subject to these Terms and any additional terms disclosed at the time.

SECTION 8 – THIRD-PARTY LINKS
Our Services may contain links to websites, applications, products, services or other resources operated by third parties. These links may include manufacturer websites, social media platforms, payment providers, shipping carriers or other external services.

Lethu Hair & Beauté does not own or control independent third-party websites or services and is not responsible for their content, availability, security, privacy practices, accuracy or operation.

The inclusion of a third-party link on our website does not necessarily constitute an endorsement, sponsorship or recommendation by Lethu Hair & Beauté.

If you choose to access or purchase products or services from a third party, your interaction or transaction may be governed by that third party’s own terms, policies and practices. You should review those terms and policies before completing a transaction or providing personal information.

To the extent permitted by applicable law, Lethu Hair & Beauté is not responsible for loss or damage arising solely from your independent dealings with a third-party website or service outside our reasonable control.

This section does not limit Lethu Hair & Beauté’s responsibility for representations we make about products we sell, orders placed directly through our Services, or any consumer rights or remedies that cannot legally be waived or limited under applicable law.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Lethu Hair & Beauté is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Lethu Hair & Beauté. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Lethu Hair & Beauté, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Lethu Hair & Beauté.

SECTION 10 – PRIVACY POLICY

Your privacy is important to Lethu Hair & Beauté. Our collection, use, disclosure, retention and protection of personal information in connection with our Services is governed by our Privacy Policy and applicable privacy laws.

When you use our Services or make a purchase, we may collect personal information reasonably necessary to process and fulfill your order, provide shipping or local pickup, process payments, communicate with you, provide customer service, prevent fraud, maintain our business records and otherwise operate our Services.

Where required, we will obtain appropriate consent before collecting, using or disclosing personal information. We will limit our collection and use of personal information to purposes that are reasonable and appropriate in the circumstances and will use reasonable safeguards to protect personal information in our custody or control.

Our Services are hosted by Shopify, and certain personal information may be processed by Shopify and other service providers that help us operate our store, process transactions, fulfill orders and provide related functionality. Their handling of information may also be subject to their applicable privacy terms and legal obligations.

SECTION 11 – FEEDBACK

We welcome reviews, comments, photographs, suggestions, ideas and other feedback relating to Lethu Hair & Beauté, our products or our Services (“Feedback”).

You are responsible for any Feedback you submit and represent that you have the right to provide it. Feedback must not be unlawful, fraudulent, misleading, defamatory, threatening, discriminatory, obscene, abusive, invasive of another person’s privacy, or infringe the intellectual property or other rights of any third party.

By voluntarily submitting Feedback for publication, including a product review, testimonial, photograph or social media content that you authorize us to use, you grant Lethu Hair & Beauté a non-exclusive, royalty-free licence to use, reproduce, display, publish and share that Feedback for reasonable business, promotional and marketing purposes, subject to applicable law.

You retain ownership of any intellectual property rights you may have in your original content. Providing Feedback does not transfer ownership of your original content to Lethu Hair & Beauté.

We may moderate, refuse to publish or remove Feedback from our Services where we reasonably believe it violates these Terms, applicable law, the rights of another person, or our website standards.

We are not obligated to compensate you for unsolicited suggestions or ideas unless we have agreed otherwise in writing before they are submitted.

Nothing in this section limits any rights or protections that cannot legally be waived under applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

We make reasonable efforts to ensure that information provided through the Lethu Hair & Beauté website and Services is accurate, complete and current. However, occasional typographical errors, inaccuracies or omissions may occur relating to product descriptions, photographs, colours, textures, lengths, ingredients, pricing, promotions, availability, shipping charges, delivery estimates or other information.

If we discover an error or inaccuracy, we reserve the right to correct or update the information as appropriate and in accordance with applicable law.

If a material error affects an order you have already placed, we may contact you to explain the issue and, where appropriate, provide you with the option to proceed with corrected information or cancel the affected item or order for a refund. We will not knowingly substitute a materially different product or charge you a higher amount than you authorized without your agreement.

Product availability and inventory levels may change, and an item shown as available may occasionally become unavailable before an order is fulfilled. If this occurs, we will contact you and provide an appropriate resolution, which may include an alternative where you agree to it or a refund for the unavailable item.

We do not undertake to update information solely because it has changed unless an update is required for the operation of our Services or by applicable law.

Nothing in this section permits Lethu Hair & Beauté to make false, misleading or deceptive representations or limits any consumer right or remedy available under applicable law.

SECTION 13 – PROHIBITED USES

You may use the Lethu Hair & Beauté website and Services only for lawful purposes and in accordance with these Terms.

You must not use our Services:

• for any unlawful, fraudulent or deceptive purpose;
• to violate any applicable federal, provincial, municipal or other law or regulation;
• to infringe or violate the intellectual property, privacy or other legal rights of Lethu Hair & Beauté or any third party;
• to submit false, misleading or fraudulent information, including payment, billing, shipping, pickup or account information;
• to make purchases using a payment method you are not authorized to use;
• to impersonate another person or misrepresent your identity or authority;
• to transmit viruses, malware, malicious code or other material intended to interfere with the security or operation of our website or Services;
• to attempt to gain unauthorized access to our website, customer accounts, systems, networks or data;
• to scrape, crawl, copy, harvest or systematically collect content or information from our Services for unauthorized commercial purposes;
• to interfere with, disrupt or circumvent security features of our website or Services;
• to harass, threaten, abuse, discriminate against or unlawfully harm another person through our Services;
• to use our website or content in connection with spam, phishing or other fraudulent activity; or
• to use our Services in any manner that violates these Terms or the rights of another person.

We reserve the right to restrict or terminate access to our Services, cancel affected orders or take other reasonable action where we reasonably believe these Terms have been violated, subject to applicable law.

Where appropriate, suspected fraudulent, unlawful or unauthorized activity may be reported to the applicable payment provider, service provider or lawful authority.

Nothing in this section authorizes Lethu Hair & Beauté to restrict, penalize or deny a customer for exercising a right or remedy available under applicable consumer protection or other law.

 

SECTION 14 – AGENTS

Lethu Hair & Beauté may engage employees, contractors, agents, service providers, suppliers and other third parties to assist in operating our business and providing the Services, including processing payments, fulfilling orders, providing shipping or delivery services, supporting local pickup, maintaining our website and providing customer service.

We may exercise our rights and perform our obligations under these Terms through such authorized representatives where appropriate.

The use of an agent, contractor or service provider does not remove or limit any responsibility that Lethu Hair & Beauté is required to assume under applicable law.

Nothing in these Terms creates an employment, partnership, joint venture, franchise or agency relationship between you and Lethu Hair & Beauté.

Third-party service providers may also be subject to their own terms, policies and legal obligations. Nothing in this section limits any consumer right or remedy that cannot lawfully be waived or restricted.

 

SECTION 15 – TERMINATION

These Terms remain in effect while you access or use the Services provided by Lethu Hair & Beauté.

You may stop using our Services at any time. If you have a customer account, you may request that it be closed by contacting us, subject to any information we are required or permitted to retain for legal, tax, fraud-prevention, transaction or other legitimate business purposes.

Lethu Hair & Beauté may suspend, restrict or terminate your access to the Services where we reasonably believe that you have violated these Terms, engaged in fraudulent, abusive or unlawful activity, compromised the security of our Services, or otherwise misused our website or Services.

Termination or suspension of access does not automatically cancel an order that has already been accepted or affect payment obligations, refunds, returns, exchanges or other rights and responsibilities arising from a transaction completed before termination.

Any provisions of these Terms that by their nature should continue after termination—including provisions relating to intellectual property, payment obligations, disclaimers, limitations of liability, indemnification and dispute-related matters—will continue to apply as appropriate.

Nothing in this section limits any cancellation, refund or other consumer right or remedy available under applicable law.

SECTION 16 – DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and Services provided by Lethu Hair & Beauté are made available on an “as is” and “as available” basis. While we make reasonable efforts to provide accurate, reliable and current information and to maintain the availability and security of our Services, we do not guarantee that the website or Services will always be uninterrupted, timely, secure or error-free.

We make reasonable efforts to accurately describe and represent the products offered through our Services. However, individual results may vary, particularly with hair-care, styling, beauty and cosmetic products. Product effectiveness, appearance and results may depend on factors including hair type, texture, condition, application, maintenance, individual sensitivities and use.

Customers are responsible for reviewing product descriptions, ingredient lists, labels, warnings, manufacturer instructions and recommended uses before using a product. Where applicable, customers should follow manufacturer recommendations regarding patch tests, strand tests, allergy or sensitivity testing, heat limitations, chemical treatments, installation and product care.

Information provided through our website, product descriptions, social media, communications or customer service is intended for general product and shopping information only and is not medical, dermatological or other professional health advice. Customers with specific health concerns, allergies or sensitivities should seek appropriate professional advice before using a product where necessary.

Products manufactured by third parties may be subject to warranties, guarantees, instructions or representations provided by the applicable manufacturer. Lethu Hair & Beauté does not provide a manufacturer warranty for third-party products unless expressly stated.

Nothing in these Terms excludes, restricts or modifies any warranty, condition, statutory guarantee, consumer right or remedy that cannot lawfully be excluded, restricted or modified under applicable Canadian or Ontario law.

 

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lethu Hair & Beauté, its owners, directors, officers, employees, agents, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Services or products purchased through the Services, where such liability may lawfully be limited.

Lethu Hair & Beauté is not responsible for losses or damages resulting from circumstances outside our reasonable control, including interruptions or failures of third-party services, shipping carrier delays, internet or telecommunications disruptions, or unauthorized third-party activity, except where responsibility cannot lawfully be excluded or limited.

Customers are responsible for following product labels, manufacturer instructions, warnings, care instructions and recommended use. To the extent permitted by applicable law, Lethu Hair & Beauté is not responsible for damage resulting from misuse, improper installation, improper storage, unauthorized alteration, failure to follow manufacturer instructions, or use of a product in a manner for which it was not intended.

Nothing in this section excludes or limits liability for fraud, intentional misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited.

Nothing in these Terms excludes, restricts or modifies any consumer right, statutory warranty, remedy or protection available under applicable Canadian or Ontario law.

SECTION 18 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Lethu Hair & Beauté and its owners, directors, officers, employees, agents, contractors and service providers from claims, losses, liabilities, damages, costs and reasonable expenses arising from your unlawful or unauthorized use of the Services, your material breach of these Terms, or your infringement of the rights of another person or entity.

This obligation does not apply to the extent that a claim, loss or liability results from the negligence, unlawful conduct or breach of legal obligations by Lethu Hair & Beauté or another party seeking indemnification.

Nothing in this section requires a consumer to indemnify Lethu Hair & Beauté for matters for which Lethu Hair & Beauté is responsible under applicable law.

Nothing in this section excludes, restricts or modifies any consumer right, protection or remedy that cannot lawfully be waived or limited under applicable Canadian or Ontario law.

SECTION 19 - SEVERABILITY

If any provision or part of a provision of these Terms is determined by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or, where necessary, severed from these Terms.

The remaining provisions of these Terms will continue to be valid and enforceable to the fullest extent permitted by law.

Where possible, an invalid or unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it lawful and enforceable while preserving its original purpose.

Nothing in this section permits the severance or modification of a provision in a manner that removes or restricts any consumer right, protection or remedy that cannot lawfully be waived or limited under applicable Canadian or Ontario law.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

If Lethu Hair & Beauté does not exercise or enforce a right or provision under these Terms at any particular time, this does not constitute a waiver of that right or provision and does not prevent us from exercising or enforcing it in the future.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping & Local Pickup Policy and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Lethu Hair & Beauté regarding your use of the Services and purchases made through them.

If any provision of these Terms conflicts with a mandatory right or protection provided under applicable law, the applicable law will prevail to the extent of the conflict.

Any ambiguities in these Terms will not be interpreted against either party solely because that party drafted or provided the wording.

Nothing in these Terms excludes, restricts or waives any consumer right, protection or remedy that cannot lawfully be excluded, restricted or waived under applicable Canadian or Ontario law.

You may not assign, transfer or otherwise delegate your rights or obligations under these Terms to another person or entity without the prior written consent of Lethu Hair & Beauté.

Lethu Hair & Beauté may assign or transfer its rights and obligations under these Terms in connection with a legitimate sale, transfer, restructuring, reorganization or succession of the business, or where otherwise permitted by applicable law.

Any assignment or transfer by Lethu Hair & Beauté will not reduce or eliminate any consumer right, protection, claim or remedy that you have under applicable law.

Nothing in this section permits an assignment or transfer that would unlawfully avoid or restrict Lethu Hair & Beauté’s obligations to customers under applicable Canadian or Ontario law.

SECTION 22 - GOVERNING LAW

These Terms of Service and any separate agreements through which Lethu Hair & Beauté provides the Services will be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any rights or remedies available to consumers under applicable law, disputes arising from or relating to these Terms, the Services or purchases made through Lethu Hair & Beauté will be subject to the jurisdiction of the courts of Ontario, Canada.

Nothing in this section prevents a consumer from exercising a right, remedy or dispute-resolution option available under applicable consumer protection legislation or other applicable law.

If a mandatory law of another jurisdiction applies to a particular transaction and cannot legally be excluded by agreement, nothing in these Terms is intended to exclude or restrict the application of that law.

The headings used in these Terms are included for convenience and organization only and will not limit, modify or otherwise affect the meaning or interpretation of any provision of these Terms.

If there is any inconsistency between a section heading and the wording contained within that section, the wording of the section will govern.

Nothing in this section affects any consumer right, protection or remedy available under applicable Canadian or Ontario law.

SECTION 24 - CHANGES TO TERMS OF SERVICE

We may update or modify these Terms of Service from time to time to reflect changes to our business, Services, policies, legal requirements or other operational needs.

The most current version of these Terms will be available on the Lethu Hair & Beauté website. Where required by applicable law, we will provide appropriate notice of material changes.

Changes will become effective on the date stated in the updated Terms or as otherwise permitted by applicable law. Changes will not retroactively remove or reduce rights that you acquired under applicable law or under the terms that applied to a transaction when it was completed.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
